JUDGMENT : Sureshwar Thakur, J. (Oral) Parties are present in Court. Today, the complainant/respondent herein in his statement on oath, reduced into writing and signatured by him, has divulged therein that he is willing to accept a sum of Rs. 1,50,000/- lying deposited in the Registry of this Court and its being ordered to be released in his favour in composition of the offence constituted against the petitioner herein arising from dishonor of Negotiable Instrument. He further states that this Revision Petition be accepted and the accused be acquitted. The statement of the accused is also recorded today on oath wherein he has accepted the offer of the respondent/complainant. In view of the consensual amicable settlement arrived at inter-se the parties at lis before this Court, the Revision petition is accepted and the impugned order is quashed and set aside. The accused stands acquitted. Consequently, a sum of Rs. 1,50,000/- lying deposited in the Registry of this Court is ordered to be released in favour of the respondent/complainant and a sum of Rs. 75,000/- lying deposited in the Nazarat of the learned Judicial Magistrate 1st Class, Rajgarh, is ordered to be released in favour of the Revisionist/accused. However, the aforesaid order shall take effect only when the petitioner/accused deposits 15% of the amount comprised in the dishonored Cheque, in Himachal Pradesh State Legal Services Authority. The learned Judicial Magistrate, 1st Class, Rajgarh, shall within 3 days on the receipt of order of this court, release a sum of Rs. 75,000/- in favour of the Revisionist/accused so as to enable him to deposit 15% of the amount of the dishonored cheque in the Himachal Pradesh State Legal Service Authority within three days thereafter. Records be sent back. All pending applications stand disposed of accordingly.
