Judgment 1. The petitioner is aggrieved against the order dated 27.05.2014. Through the impugned order he was transferred from Thanjavur to Pattukkottai. 2. The petitioner was working as Sub-Inspector of Survey for Municipality, Thanjavur. The grievance of the petitioner is that the such transfer order is passed at the verge of his retirement only to accommodate the third respondent herein at Thanjavur. The petitioner further contended that he is due to retire in the month of June 2015 and therefore, as per norms and guidelines prescribed by the department he should have been permitted to continue in the place where he was working before passing the impugned order of transfer. 3. Heard both sides. 4. It is seen that the petitioner was transferred from Thanjavur to Pattukkottai in pursuant to the impugned order, dated 27.05.2014. 5. It is admitted by the learned counsel for the petitioner that the petitioner has joined the transferred place immediately and however, he is on leave for the past eight months. 6. The learned counsel appearing for the petitioner submitted that the petitioner may be permitted to make a representation seeking for considering his case for transferring to his original place, namely, Thanjavur, based on the relevant Rules and Guidelines in respect of persons, who are at the verge of retirement. Needless to say that it is open to the petitioner to make any such request and if such request is made, it is for the respondents to consider the same and decide it on merits by applying the relevant Rules, and guidelines, if any, while considering the request of the petitioner, who is at the verge of retirement. 7. Accordingly, the Writ Petition is disposed of only with a liberty to the petitioner to make a representation to the second respondent, within a period of two weeks from the date of receipt of a copy of this order. While making such representation, the petitioner is at liberty to raise all the points, which is in favour as per the service Rules. On receipt of such representation, the second respondent can consider the request of the petitioner and pass orders on the same on merits and in accordance with law, within a period of two weeks, thereafter. No costs. Consequently, connected Miscellaneous Petitions are closed.
