JUDGMENT Manoj Kumar Gupta, J. The subject matter of the grievance in this PIL is lands bearing Gata No. 18 area 0.081 hectare and Gata No. 542 area 0.089 hectare situated at Village Akhbandpur, Police Station Saidangali, Tehsil and District Sambhal. The revenue extract indicates that lands are reserved as graveyard and the grievance is that an unauthorized construction has been made thereon. 2. Under the provisions of Section 122B of the U.P. Z.A. & L.R. Act 1950, sufficient statutory remedies are available for dealing with unauthorized encroachment on a public utility land. 3. Hence, this Court, without expressing any finding on the factual correctness of the grievance of the petitioner since this would warrant an inquiry with due notice to all aggrieved private respondents, disposes of the petition by leaving it open to the petitioner to move the Sub Divisional Magistrate, Sambhal (the third respondent) for an inquiry in accordance with law, as may be warranted. We clarify that all the rights and contentions of the parties shall be duly addressed in the inquiry and this order shall not be construed as any finding or opinion of the Court on the merits of the allegation. The petition is, accordingly, disposed of. There shall be no order as to costs.
