JUDGMENT P.S. Rana, J. 1. Himachal Pradesh Road Transport Corporation (respondent No. 1) offered Rs. 2,60,000/- (Rupees two lac sixty thousand only) as full and final settlement. Learned Advocate appearing on behalf of Himachal Pradesh Road Transport Corporation submitted before the Court that he has been authorized by Himachal Pradesh Road Transport Corporation to give offer. Offer given by Himachal Pradesh Road Transport Corporation is accepted by learned Advocate appearing on behalf of the appellant. Learned Advocate appearing on behalf of the appellant, however, submitted that he has also been instructed by his client to give statement before the Court. In view of the above stated facts, award passed by the Motor Accidents Claims Tribunal (III), Shimla, H.P. is modified and award to the tune of Rs. 2,60,000/- (Rupees two lac sixty thousand only) is passed in favour of the appellant and against co-respondent No. 1. Statements of learned Advocates recorded and they shall form part and parcel of the award. No interest will be paid upon the enhanced award. Award passed by the Motor Accidents Claims Tribunal (III), Shimla, H.P. is modified accordingly. 2. Award amount will be deposited within one month from today, failing which, co-respondent No. 1 will pay interest @ 9% per annum qua the enhanced amount. No order as to costs. 3. The appeal is disposed of accordingly alongwith all pending applications.
