At this stage learned Advocate appearing on behalf of the respondent submitted before the Court that he has no objection if application filed under Order 6 Rule 17 read with Section 151 CPC is allowed subject to heavy cost. In view of the above submission of the learned Advocate appearing on behalf of the respondent order of learned Trial Court passed in CMA No. 87-6 of 2014, dated 18.09.2014 is setaside and application filed under Order 6 Rule 17 read with Section 151 CPC for amendment of the reply is allowed in the interest of justice. Costs to the tune of Rs.3000/- (Rupees three thousand only) is imposed upon the petitioners. The learned Rent Controller will dispose of main petition No. 16-2 of 2012 titled Ram Lal Misra vs. M/s Ambey Automobiles and others within two months from today. Service of witnesses if any will be affected by way of special messenger strictly in accordance with law. Certified copy of order be immediately sent to the learned Rent Controller for compliance. Petition is disposed of. Pending applications, if any, also disposed of.
