JUDGMENT Mr. Raj Mohan Singh, J.: (Oral) - Petitioner seeks grant of regular bail under Section 439 Cr.P.C. in case bearing FIR No. 260 dated 17.7.2014 under Section 364, 120-B IPC, registered at Police Station Sadar Sirsa, District Sirsa. 2. The FIR came to be registered at the instance of complainant Usha wife of Krishan Kumar Munjal with the allegations that the complainant was present in Dera Sacha Sauda for attending ‘Satsang’ along with her minor daughter Sukhleen. When the daughter was playing, she was kidnapped by someone. Hectic search did not yield anything. It is only in CCTV coverage that a lady was found taking the minor daughter along with her. Locket bearing No. 3014846 of that lady was found in the room from where her location was traced out and ultimately she was found to be Nirmala wife of Sunder, resident of Daholi, Tehsil Ramgarh, District Alwar. The FIR was registered on the basis of doubt that the minor daughter of the complainant was kidnapped with a view to sacrifice her. 3. Learned counsel for the petitioner relies upon cross-examination of the complainant, wherein she has deposed that the insertion of words “Mujhe shak hai k ukkat aurat ne meri bachhi ko bali chdane ke liye aagwa karke le gyi hai” was on account of police interference just to make the occurrence more heinous. 4. Learned counsel for the petitioner further relies upon the concluding part of the cross-examination to show that the complainant did not intend to name the petitioner and others except Nirmala and she shows no grievance against the petitioner. The aforesaid wording was intentionally got inserted by the police in order to bring out the offence from the ambit of Section 363 IPC which is bailable in nature. The petitioner is in custody since 8.9.2014. 5. Without commenting anything on the merits of the case, the petitioner is directed to be released on regular bail subject to his furnishing adequate bail bonds and surety bonds to the satisfaction of the trial Court. 6.
