Judgment 1. This petition is filed seeking a direction to direct the learned Judicial Magistrate, Pudukottai, to dispose of the Cr.M.P.No.8669 of 2014 in M.C.No.7 of 2014 on merits without insisting their personal appearance. 2. Heard the learned Counsel appearing for the petitioners. 3. Learned Counsel appearing for the petitioners submits that the learned Judicial Magistrate, Pudukottai, insisted on the appearance of the petitioners before him towards consideration of the petition moved by the petitioners in Cr.M.P.No.8669 of 2014 in M.C.No.7 of 2014 for setting aside the ex-parte order made against the petitioners. M.C.No.7 of 2014 has been moved by the respondent seeking relief under the Protection of Women from Domestic Violence Act. 4. Learned Counsel appearing for the petitioners submits that the third petitioner is a paralytic, and the second petitioner has to take care of her and that the fourth petitioner is residing independently with her family. Learned Counsel appearing for the petitioners submits that the first petitioner will appear before the Court below without fail. 5. In these circumstances, this Court disposes the Criminal Original Petition with a direction to the learned Judicial Magistrate, Pudukottai, to take up the Cr.M.P.No.8669 of 2014 in M.C.No.7 of 2014 and pass orders on merits therein by accepting petitions under Section 317 Cr.P.C moved on behalf of the petitioners 2 to 4. As the present order has no bearing on the merits of the case, this Court does not consider it necessary to issue notice to the respondent.
