ORDER : 1. We have heard learned counsel appearing for the petitioner. 2. The petitioner has been selected in the Assistant Conservator of Forests Examination, 2011 conducted by Rajasthan Public Service Commission, for which the eligibility, as well as the requirement of physical fitness, is provided under Rule 13 of the Rajasthan Forest Service Rules, 1962. He was required to undergo a medical examination, in which his height was found to 162.5 cms. by the Medical Board/Doctors, whereas the requirement of height under Rule 13 is 1.6256 metres, rounded off to 163 cms. 3. It is submitted by learned counsel appearing for the petitioner that the Medical Jurist in Satellite Hospital, Jaipur had measured his height to 163 cms. For all other purposes, the Medical Board had found him fit. 4. The petitioner made a representation to the Chief Secretary, Department of Forest & Environment, Government of Rajasthan, Secretariat Building, Rajasthan, Jaipur, for remeasurement of his height. 5. By this writ petition, the petitioner has challenged the minimum height prescribed under Rule 13, on the ground of discrimination as no such prescription for height is made for promotion from the post of Ranger Grade II to the post of Assistant Conservator of Forests, and there is no prescription of measurement in the Indian Forest Service (Recruitment) Rules, 1966 and the Indian Forest Service (Appointment by Induction) Regulations, 2013, for the post of Assistant Conservator of Forests, by way of direct recruitment. 6. At this stage, we are not inclined to consider the validity of the Rules, inasmuch as at the first instance, his representation for remeasurement of his height, which according to him is 163 cms requires consideration. 7. The petitioner was declared successful in the selections by the Rajasthan Public Service Commission, and that, his measurement of height has been found to be fractionally lesser than the minimum height prescribed. To avoid the possibility of any error, which may affect his career prospects, we direct the respondents to decide the petitioner's representation within one month, from the day he submits a copy of it with this order. While deciding the representation, the respondents will get his height remeasured from a Medical Board, and give reasons, in taking a decision on the representation, which will be communicated to the petitioner. 8. The Writ Petition is accordingly disposed of.
