JUDGMENT The prayer in this writ petition is as follows: “1. A writ, order or direction in the nature of Mandamus, directing Respondent No. 2 and 3 to ensure the safety and security of life and property of the petitioners. 2. A writ, order or direction in the nature of Mandamus, directing Respondent No. 2 and 3 to investigate into the matter in pursuance of the complaints filed by the petitioners. 3. Issue, any other and further order which this Hon’ble Court may deem fit and proper in the facts and circumstances of the present case. 4. Award cost of the writ petition to the petitioners.” 2. Briefly put the case of the petitioners is as follows. The petitioners had entered into a partnership with party respondent nos. 4 to 7. There was a land in the name of the petitioners, which was introduced in the firm. Petitioner nos. 1 to 3 constructed a property apportioned in the land managed by the partnership firm. Respondents no. 5 and 6 are alleged to be taking arbitrary decision on major policies. There is allegation of verbal abuse and threats of physical harm to the petitioners. In order to maintain civility and sanctity, petitioner nos. 1 and 3 left their residence and property at Village Chanauti, Naukuchiatal. They allegedly found some irregularities in the books of accounts. It is alleged that the petitioners are getting threat messages and phone calls from respondent nos. 5 and 6. Petitioners were informed that their house property has been broken into and their personal belongings and other valuables have been removed from their house property. Petitioners had filed a complaint before the Police, but it is alleged that the police are not giving any heed to the same. Hence, this petition. 3. Learned Additional Advocate General would, in fact, submit on instructions, that essentially, it is a matter, which pertains to a civil dispute. 4. We are also of the view that this may not be an appropriate case, where we should interfere in our extra ordinary jurisdiction under Article 226 of the Constitution. Without prejudice to all the remedies, which are available to the petitioners, this writ petition is closed.
