ORDER P. S. Rana, J. (Oral) Present anticipatory bail application filed by S/Sh. Rajiv Rai and Paresh Sharma who are practising Advocates in the Hon’ble High Court of Himachal Pradesh. Affidavit filed by SHO, Police Station, Boileauganj Distt. Shimla. There is recital in the affidavit that no case is registered against the petitioners. It is well settled law that anticipatory bail is granted in non-bailable criminal offence only. In view of the fact that no criminal case is registered against the petitioners namely S/Sh. Rajiv Rai and Paresh Sharma as of today present application filed under Section 438 Cr. PC for anticipatory bail is dismissed as infructuous. However it is further directed that in case FIR is registered against Sh. Rajiv Rai and Sh. Paresh Sharma relating to non-bailable criminal offence qua same facts at subsequent stage then prior arrest notice of seven days will be given to petitioners by SHO, Police Station, Boileauganj Distt.
