Judgment :- 1. Mr.G.R.Swaminathan, learned Additional Solicitor General of India takes notice for the respondents and by consent of both the parties, the main writ petition itself is taken up for final disposal at the stage of admission. 2. Heard the learned Counsel appearing for the petitioner and the learned Additional Solicitor General of India appearing for the respondents. 3. The petitioner seeks for a Writ of Mandamus to direct the respondent to grant Ex-Servicemen's Military Family Pension to the petitioner. 4. The case of the petitioner is that her husband namely P.Kamatchiappan, served as Rank Spr 1329601 in the Defence and he has retired from service. It is her further case that after his retirement, he died on 18.03.2008, and consequently the petitioner is entitled to get the military family pension. It is stated that such pension has not been given to the petitioner so far. 5. It is seen that the petitioner has made the representations seeking for grant of Military Family Pension on 04.02.2014 and again on 07.02.2014. Therefore, it is for the first respondent to consider the request of petitioner and decide the same on merits and in accordance with law. 6. Accordingly, the writ petition is disposed of only with a direction to the first respondent to consider the representations of the petitioner dated 04.02.2014 and 07.02.2014 and pass orders on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order. No costs.
