Judgment :- 1. The challenge in this writ petition is to the de-occupation notice dated 10.12.2014 issued by the second respondent under Section 56(2A) and 57 read with Section 85 of the Tamil Nadu Town and Country Planning Act, 1971 (for short “the Act”). 2. During the course of arguments, it is stated by the learned counsel for the petitioner that the aforesaid notice has been challenged before the Government under Section 80-A of the Act. 3. Thus, at this stage, this writ petition is premature. If the appeal/revision, as aforestated, is pending consideration before the authorities, they are directed to consider the same and pass orders in accordance with law and on its own merits within the specific period prescribed in the second proviso to Section 80-A of the Act. 4. This writ petition is disposed of with the above direction. No costs. Connected Miscellaneous Petition is closed.
