JUDGMENT Shri Narayan Shukla, J. Heard Mr. Ajay Shukla holding brief of Mr. Manish Jauhari, learned counsel for the petitioner. 2. The petitioner has prayed for issuing a writ of mandamus commanding the Additional District Judge/Special Judge (C.B.I.-2), Lucknow to decide the Rent Appeal No. 72 of 2013 expeditiously. 3. Learned counsel for the petitioner has submitted that the petitioner is landlord of House No. 86/66, Kurmi Tola, Maqboolganj (near Risaldar Park), Lucknow and the opposite party no. 1 is tenant. Being in bonafide need of the said house, the petitioner preferred an application under Section 21 of U.P. Act No XII of 1972 before the Prescribed Authority/Additional, JSCC, Court No. 18, Lucknow, which was allowed on 31.10.2013 with the direction to the opposite party no. 1 to vacate the portion under the tenancy within two months. 4. Aggrieved opposite party no. 1 preferred a rent appeal against the order dated 31.10.2013, which is registered as Rent Appeal No. 72 of 2013 before the District Magistrate. The District Magistrate has admitted the rent appeal on 30.11.2013 and has fixed several dates for its disposal but the opposite party no. 1 has sought unnecessary adjournment on several times. Thus, since he has in occupation in the rented portion of the house, he is not interested to get decided the appeal expeditiously. The order sheet of the appeal has been brought on record. After perusal of which I find that several adjournments have been sought by the opposite party no. 1, therefore, I am of the view that the matter requires direction of this Court for expeditious disposal. 5. Accordingly, the writ petition is disposed of with the direction to the respondent no. 2-Additional District Judge/Special Judge (C.B.I.-2), Lucknow to dispose of the Rent Appeal No. 72 of 2013 after providing opportunity of hearing to the parties concerned expeditiously without giving unnecessary adjournment.
