Judgment 1. Heard the learned Counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents. Though notice was ordered and served on the third respondent in this matter, he has not chosen to appear and on the other hand his name is printed in the cause-list today. 2. In this writ petition, the petitioner is seeking for a Writ of Mandamus directing the respondents 1 and 2 to direct the third respondent to disburse the arrears of salary and the monthly salary amounting to Rs.1,08,360/- with 18% interest from 01.10.2010. 3. It is the case of the petitioner that certain amount of salary arrears payable by the third respondent has not been paid to the petitioner in spite of a direction issued by the second respondent on 15.05.2013. 4. According to the petitioner, the salary arrears amounts to Rs.1,08,360/-. The third respondent has not come forward to place any material facts before this Court with regard to the claim made by the petitioner. 5. Therefore, this Court is not in a position to give any findings as to whether the petitioner is entitled to get arrears of salary or not. However, as it is seen that the petitioner has made a representation dated 14.07.2014, before the first respondent, the same shall be considered and decided by the first respondent after hearing the petitioner as well as the third respondent and pass suitable orders on merits. Such exercise shall be done by the first respondent within a period of eight weeks from the date of receipt of a copy of this order. Accordingly, the writ petition is disposed of. No costs.
