JUDGMENT Ashwani Kumar Mishra, J. Plaintiff-petitioner's suit for declaration and mandatory injunction filed in the year 2004 has remained pending. The grievance is that the court concerned is routinely granting adjournment in the matter, in teeth of the provisions of the Code of Civil Procedure. prayer has been made to expedite the proceedings. Considering the above, the petition stands disposed of, directing the court concerned to expedite the proceedings of Original Suit No. 562 of 2004 and to conclude the same, without granting unnecessary adjournments to either of the parties, keeping in view of the provisions of Code of Civil Procedure, by fixing short dates, at the earliest possible.
