JUDGMENT Hon’ble Sudhanshu Dhulia, J. (Oral) 1. This is the tenant’s writ petition arising out of a proceedings under Section 21 (1)(a) of the U.P. Urban Buildings (Regulation of Lettings, Rent & Eviction) Act, 1972 (hereinafter referred to as “Act No. 13 of 1972”) filed by the respondent/landlord on the ground of bona fide need. The release application of the landlord/respondents has been allowed and the appeal of the tenant filed under Section 22 of Act. No. 13 of 1972 has been dismissed, hence the present writ petition. 2. Heard learned counsels for the parties and perused the impugned orders passed by the courts below. From the perusal of the record it reveals that all the findings pertaining to the bona fide need as well as comparative hardship are against the petitioner and in favour of the landlord. 3. Before arguing the matter, learned counsel for the petitioner fairly submits that only one month time has been given by the court below to the petitioner to vacate the premises in question. The petitioner further submits that being a poor woman, she needs reasonable time to shift and look for an alternate accommodation. Learned counsel for the respondents has no objection in case the Court fix reasonable time to vacate the premises in question. 4. In view of this Court one year would be reasonable time to look for an alternate accommodation and to vacate the premises in question. No interference is presently called for in the impugned orders dated 21.12.2012 and 20.01.2015 passed by the Prescribed Authority, Dehradun and Additional District Judge 1st, Dehradun respectively. 5. Accordingly, the writ petition is dismissed. However, the request for one year to vacate the premises in question is granted to the petitioner. The petitioner/tenant shall handover the peaceful possession of the property in dispute on or before 01.03.2016 to the respondent/landlord, provided the petitioner shall give an affidavit to this effect before the court below, and pay the rent regularly for this period.
