ORDER 1. In this writ petition, the petitioner is seeking for quashing of Election Notification dated 06.07.2015, whereby the election of Adhyaksha and Upadhyaksha of Astoor Gram Panchayath was scheduled on 20.07.2015. 2. I have heard the learned counsel appearing for the parties and perused the record. The contention urged by the learned counsel for the petitioner is that, pursuant to the amendment to Section 46 of the Karnataka Panchayath Raj Act, 1993 (‘the Act’) by the Karnataka Panchayath Raj (Amendment) Act, 2015 (Karnataka Act No. 17 of 2015), the term of office of Adhyaksha of Grama Panchayath is increased from thirty months to five years, and therefore, the petitioner is entitled to continue as Adhyakasha till completion of the tenure of five years. Hence, the election scheduled on 20.07.2015 is illegal and, therefore, the impugned election notification dated 06.07.2015 is liable to be quashed. 3. It is stated by the learned counsel for the petitioner, that the petitioner was elected as Adhyaksha of the Astoor Gram Panchayath on 17.10.2012. If that be so, as per Section 46 of the Act as it stood prior to the aforesaid amendment, the petitioner’s term of office of thirty months came to an end on 16th April 2015. The amendment Act which increased the term of office from thirty months to five years, came into force on 30th April 2015. By that time, the petitioner’s term as Adhyaksha had already come to an end and she had ceased to be the Adhyaksha. Though the amendment was by way of substitution, the petitioner’s term of office as Adhyaksha had ended before the date of coming into force of the Amendment Act. Hence, the amendment to Section 46 of the Act by Karnataka Act No. 17 of 2015 will not apply to the petitioner to continue as Adhyaksha for the extended period. The writ petition is devoid of merit and it is accordingly dismissed. Petition dismissed.
