Judgment :- 1. The petitioner in Crl.O.P.(MD) No.2794 of 2015 seeks a direction to the respondents to provide adequate police protection for “Sivarathri Pooja” based on the representation dated 10.02.2015, to be held on 17.02.2015 by the petitioner and to permit the petitioner to take “Virumandi Samy Petti”. 2. The petitioner in Crl.O.P.(MD) No.2492 of 2015 also seeks a similar relief informing that as there was a dispute regarding lifting of hereditary box used in Maha Masi Sivarathiri Festival, he is using a new 'petti' for such purpose and for the past two years there have been no disturbances owing thereto. 3. The counter of the second respondent police informs of the likelihood of law and order problem if the petitioner in Crl.O.P.(MD) No.2492 of 2015 is directed to 'lift the box' and that besides the two petitioners before us, one other group led by one Pandi has filed a petition on behalf of the Villagers opposing grant of permission to take the new box to Karumathur as intended by the petitioner in Crl.O.P.(MD) No.2492 of 2015. 4. Learned counsel for the petitioner in Crl.O.P.(MD) No.2794 of 2015 would restrict the relief claimed to one permitting such petitioners group to conduct worship at the Arulmighu Munusamy Temple at fixed hours. 5. Learned counsel for the petitioner in Crl.O.P.(MD) No.2492 of 2015 submits that the intent of the petitioners in Crl.O.P.(MD) No.2794 of 2015 only is to prevent the lifting of the 'petti' on the auspicious day. 6. This Court would not go into the intent of the parties before us, good or otherwise. That there are rival parties before this Court affirms the pendency of dispute. The respondent police inform that permitting the lifting of the 'petti' would lead to law and order problems and particularly that a petition stands filed on behalf of the villagers against permitting the same. It is seen the petitioner in Crl.O.P.(MD) No.2492 of 2015 has already moved action in O.S.No.48 of 2014 on the file of the District Munsif, Thirumangalam regards the dispute. The concern of the respondents are also to be considered. 7. In the circumstances, this Court considers it appropriate to restrict the rights of both petitioners to conduct worship in Arulmighu Munusamy Temple.

The second respondent police is directed to offer police production at Arulmighu Munusamy Temple, Thanakankulam Village, Thirupparankundram Circle, Madurai District to enable (i) The petitioner in Crl.O.P.(MD) No.2492 of 2015 and his group to observe worship on 17.02.2015 between 6.00 p.m. and 8.00 p.m. (ii) The petitioner in Crl.O.P.(MD) No.2794 of 2015 and his group to observe worship on 17.02.2015 between 8.30 p.m. and 10.30 p.m. 8. These Criminal Original Petitions stand disposed of accordingly.
