ORDER 1. Heard. 2. This is 2nd repeat application under section 439 of CrPC for grant of bail to applicant Vishal s/o Sukhdev Maratha. 3. His first application was dismissed as withdrawn by order dated 9.2.2015. 4. This repeat application has been filed after recording the statements of prosecutrix (PW1) and her husband (PW2) on 24.6.2015. He has drawn my attention to Para-8 of the statement of prosecutrix and Paras 4 and 6 of the statement of her husband (PW2), wherein no allegation of rape has been made against the present applicant nor he has been identified by them. 5. In view of the aforesaid, I am inclined to allow this repeat bail application, without expressing any opinion on merits of the case, I allow the Miscellaneous Criminal Case No. 6084 of 2015 bail application and it is directed that applicant-Vishal be released on bail subject to his furnishing a personal bond in the sum of Rs.30,000/- (Rupees Thirty thousand Only) with one local surety in the like amount to the satisfaction of the concerned JMFC/CJM for his appearance before him or trial Court, as the case may be, on all dates of hearing as may be fixed in this behalf by the Court concerned during trial.
