ORDER P.S. Rana, J. Heard. Learned Advocate appearing on behalf of the petitioner submitted that present petition be converted into civil revision petition under Section 115 of the Code of Civil Procedure. Learned Advocates appearing on behalf of the non-petitioners submitted that they have no objection if the present petition is converted into civil revision petition under Section 115 of the Code of Civil Procedure. In view of the above stated facts present petition under Article 227 of the Constitution of India is converted into civil revision petition under Section 115 of the Code of Civil Procedure in the ends of justice. 2. With the consent of the learned counsel for the parties following order passed: (1) That one opportunity will be granted by the learned Motor Accident Claims Tribunal Ghumarwin Distt. Bilaspur (H.P.) to the petitioner to adduce evidence through the Court. (2) That service of the official witnesses will be effected through special messenger. (3) Costs to the tune of Rs.1000/- (Rupee one thousand) is also imposed. (4) Parties are directed to appear before the Motor Accident Claims Tribunal Ghumarwin Distt. Bilaspur (H.P.) on date 28.08.2015. 3. Order of learned Motor Accident Claims Tribunal dated 03.12.2014 announced in MAC No. 06-2/2011 titled Shishu Pal vs. Raj Kumar & Others is modified to this extent only. Records of learned Motor Accident Claims Tribunal along with certified copy of this order be transmitted forthwith. Civil Revision Petition No. 135/2015 is disposed of. Pending application(s) if any also disposed of. No order as to costs.
