ORDER 1. This revision under section 397 read with section 401 of the CrPC has been filed against the order dated 13.4.2016 passed by learned Second Additional Sessions Judge, Rajgarh in S.T. No.505/2015 whereby framed the charge under section 306/34 of the IPC against the applicants. 2. As per prosecution case, deceased Siddharth @ Siddhanath was running a Call-Center at Rajgarh in the name of “Hanuman Chalisa” which was operated as per the instructions and guidance received from the applicants viz. Anil Jain and Smt.Afrin Khan. On 16.5.2015 deceased committed suicide by hanging. Merg No.19/2015 was registered at Police Station Kotwali, Rajgarh. An inquiry was made and a suicidal note was recovered. As per suicidal note, applicants had assured the deceased that they will provide him financial assistance. On their assurance deceased had taken loan from different persons. After repeated demands, applicants had not provided him money. Resultantly, under pressure, deceased committed suicide. On the basis of inquiry report, Crime No.234/2015 for the offence under section 306/34 of the IPC has been registered against the applicants. After investigation, final report has been filed. 3. Considering the material on record, learned ASJ by the impugned order framed the charge against the applicants for the offence under section 306/34 of the IPC. Being aggrieved, applicants have filed this revision. 4. Learned counsel for the applicants submits that the applicants never met or made any conversation with the deceased personally or telephonically. The prosecution has not produced any evidence that the applicants would provide financial assistance to the deceased for opening the Call-Center at Rajgarh. Even in the suicidal note, there is no allegation that the applicants used to harass the deceased physically or mentally. There is no evidence to presume that the applicants have abated or instigated the deceased to commit suicide. Hence, there is no material for framing the charge against the applicants under section 306 of the IPC. For this purpose, he placed reliance on the judgment of this Court in the case of Babbi @ Jitendra v. State of M.P. [ 2008(III) MPWN 8 = 2008(2) MPHT 160 ]; and Surendra Pathak v. State of M.P. [2016(1) MPLJ (Cri.) 342]. 5. On the other hand, learned Deputy Government Advocate supports the impugned order and submits that at the time of framing of charge, minute scrutiny is not required.

From bare reading of the facts, it cannot be presumed that the applicants have physically or mentally harassed the deceased. On the assurance of applicants, deceased had taken loan from different persons. It seems that the applicant had assured the deceased for financial assistance, however, they have not provided the same, therefore, out of frustration, deceased has committed suicide. If the applicants refused to provide financial assistance to the deceased, it cannot be presumed that the accused have goaded or provoked, incited or urged or encouraged the deceased to commit suicide. From the facts it cannot be inferred that the applicants have intended that the deceased should commit suicide. 8. In view of the above discussion I am of the view that there is no material on record to presume that the applicants have committed offence under section 306 of the IPC. Hence, learned ASJ has committed an error in framing the charge under section 306 of the IPC against the applicants. 9. Accordingly, this revision is allowed and the impugned order dated 13.4.2016 framing charge against the applicants under section 306 of IPC is hereby set aside. The applicants are discharge from the charge under section 306 of the IPC. Their bail-bonds also stand discharged. 10. Let a copy of this order be sent to the trial Court for information and compliance.
