JUDGMENT : Sandeep Mehta, J. Heard learned counsel for the parties. Perused the material available on the record. 2. The instant second bail application under Section 439 Cr.P.C. has been filed by the petitioner who is in custody in connection with F.I.R. No. 287/2015, P.S. Khamera, District Banswara for offences under Sections 420 and 406 IPC. 3. The earlier bail application filed on behalf of the petitioner was rejected on 3.5.2016 giving him liberty to file fresh bail application after completion of investigation. Now the charge-sheet having been filed, the instant second bail application has been filed. 4. Having regard to the overall facts and circumstances of the case and considering the fact that the charge-sheet has been filed against the petitioner for Magistrate triable offences and as trial is likely to consume time, but without expressing any opinion on the merits, this Court is of the opinion that the petitioner deserves to be released on bail. 5. Accordingly, the instant second bail application is allowed and it is directed that the petitioner Shankar arrested in connection with the F.I.R. No. 287/2015, P.S. Khamera, District Banswara, shall be released on bail provided he furnishes a personal bond of Rs.50,000/- and two surety bonds of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
