AMITAVA ROY, PINAKI CHANDRA GHOSE

body2016
JUDGMENT : Leave granted. 2. Heard the learned counsel for the parties. 3. We have gone through the impugned order passed by the High Court. In our view, no cogent reason has been given by the High Court, while deciding the Criminal Writ Petition No.3917 of 2014, to reach the conclusion that the respondent herein did not create any false document. The order of the Session Judge was also placed before us. Hence in our view, the matter should be remanded to the High Court for hearing of Criminal Writ Petition No.3917 of 2014 afresh, in accordance with law, within four weeks. 4. Accordingly, we allow this appeal on this ground alone, set aside the impugned order of the High Court and remand the matter to the High Court for a fresh decision, in accordance with law with a request to the High Court to decide the matter within four weeks from the date of receipt of a copy of this order. 5. Liberty is granted to the parties to produce all the relevant documents before the High Court. 6. The High Court shall hear and dispose of the appeal by passing a reasoned order and without being influenced by the observations made by us in this order or by the High Court in the impugned order. 7. We, however, make it clear that we have not expressed any view on the merits of the controversy.
