body2016
ORDER : Vijay Bishnoi, J. 1. This writ petition has been filed by the petitioner aggrieved against the judgment and award dated 11.05.2016 passed by the Motor Accident Claims Tribunal (Additional District & Sessions Judge), Salumbar, Udaipur, whereby the respondents have been awarded a sum of Rs. 7500/- along with interest for the injuries suffered by them. 2. Learned counsel for the petitioner submits that though the amount involved in the present writ petition is meagre, however, as the petitioner has questioned award dated 11.05.2016 passed in the cases of Gopichand v. Mahendra Kumar & Others and Smt. Savita v. Mahendra Kumar & Others, which arose out of the same accident, wherein the sum of Rs. 3,20,000/- and Rs. 1,18,780/- respectively have been awarded as compensation, the petitioner is required to question the finding of negligence and the petitioner's liability in the present matter as well. 3. I have heard learned counsel for the petitioner and have perused the material placed on record. 4. Looking to the meagre sum involved in the present writ petition, no interference is called for in the present writ petition. However, the dismissal of the present writ petition on account of involvement of meagre sum would not effect the defense/submissions raised by the petitioner on merits, in other appeal arising out the same award. With the above observations, the writ petition is dismissed. Stay petition also stands dismissed. Petition dismissed.
