Ajit Singh; CJ.:-- Mr. HRA Choudhury, learned senior counsel, assisted by Mr.J Islam and Mr.FU Borbhuiya, learned counsel for the appellants. Mr. AR Bhuyan, Mr.MAI Hussain and Mr. KR Islam, learned counsel for Caveator and Ms.RB Bora, learned counsel for respondent No. 3. This writ appeal is directed against the order dated 29.11.2016 passed by the learned Single Judge of this High Court whereby, he has allowed WP(C) No. 7625/2015 of Respondent No. 1. Respondent No. 1 is President of No. 82 Janata Gaon Panchayat. The appellants initiated No Confidence Motion against him. And, in the meeting held on 10.12.2015, resolution of No Confidence was also passed. Aggrieved, Respondent No. 1 challenged the resolution in WP(C) No. 7625/2015 on the ground of non-compliance of mandatory provision of Section 15(1) of the Assam Panchayat Act inasmuch as the Secretary of the Gaon Panchayat had never placed the requisition before him seeking his approval in the matter. The learned Single Judge agreed with Respondent No. 1 and by the impugned order has quashed the resolution of No Confidence passed against him. The learned Single Judge has also observed that it would be open for the appellants to move the competent authority with a fresh requisition, and in the event of such requisition, the same be processed in accordance with law. The learned senior counsel, appearing for the appellants, instead of pressing this appeal on merit, has prayed that the appeal be disposed of with a direction that if fresh requisition for No Confidence is moved, the same be processed expeditiously in accordance with law. To this prayer, the learned counsel for Respondent No. 1 has fairly agreed. We, therefore, finally dispose of the present appeal with a direction that in the event of appellants’ moving fresh requisition for No Confidence against Respondent No. 1, the same be processed in accordance with law expeditiously.
