JUDGMENT : K.M. Joseph, J. Petitioner challenges the order of the State Public Services Tribunal of Uttarakhand dated 26th August, 2015; he also seeks to quash the order dated 29.07.2003. 2. Petitioner was promoted to the post of Forest Guard in the year 2001. By the order impugned dated 29.07.2003, which is impugned both before this Court and before the Tribunal, petitioner was reverted; he was reverted for the reason that he did not pass the High School examination, instead he claimed to be qualified on the basis of his having passed PRATHMA and MADHYAMA from Hindi Sahitya Sammellan in the years 1991 and 2001 respectively. It is challenging the order dated 29.07.2003 that he filed a claim petition before the Tribunal. The Tribunal dismissed the claim petition. Hence, the writ petition. 3. We heard the learned counsel for the petitioner and the learned Deputy Advocate General for the State. 4. The Tribunal has, in fact, relied on a body of case law, wherefrom it becomes clear that the claim of the petitioner for equivalence of the qualifications of PRATHMA and MADHYAMA is completely untenable. 5. Learned counsel for the petitioner drew our attention to the order dated 22.08.1998. Learned Deputy Advocate General, on the other hand, points out that a perusal of the order of the Tribunal would show that this order has been superseded by the order dated 28.10.1998. In such circumstances, there is absolutely no illegality committed by the Tribunal while dismissing the claim petition. 6. Learned counsel for the petitioner Sri Sandeep Tiwari submits that the petitioner has been given further promotion. He points out that the petitioner has subsequently passed High School in the year 2004. 7. We, while dismissing the writ petition, make it clear that nothing in this judgment will stand in the way of the petitioner representing for being considered for any vacancy, for which, he is otherwise entitled on the basis of his possessing requisite qualification, provided there is any such vacancy available.
