JUDGMENT : G.R. MOOLCHANDANI, J 1. This appeal has been directed against the judgment dated 20.12.2006 passed by Additional Sessions Judge No.1, Sri Ganganagar in Sessions Case No.6/2006 whereby the learned trial court has convicted and sentenced the appellant-accused as under:- U/Sec.302 I.P.C. Life imprisonment and a fine of Rs.1,000/-, in default of payment of fine, further to undergo two months rigorous imprisonment. U/Sec.394 I.P.C. Five years rigorous imprisonment and a fine of Rs.500/-, in default of payment of fine, further to undergo two months rigorous imprisonment. U/Sec.449 I.P.C. Five years rigorous imprisonment and a fine Rs.200/-, in default of payment of fine, further to undergo one months rigorous imprisonment. U/Sec.201 I.P.C. Three years rigorous imprisonment, and a fine of Rs.200/-, in default of payment of fine, further to undergo one months R.I. 2. In nutshell, the story of the prosecution is that Vinod Kumar son of deceased Smt. Vidhya Rani submitted a report Exhibit P.8 regarding unnatural death of his mother by fire ignition, on which a morgue was registered at serial No.4/2006 under Section 174 Cr.P.C. on 14.3.2006. Subsequently, on the findings of post mortem report and detection of empty liquor bottle near the bed and disappearance of the jewellery of the deceased and detection of blood stains on the Razai cover and bed sheet, a regular FIR No.40 dated 22.3.2006 Exhibit P.41 was lodged under Sections 302, 201 and 394 I.P.C., after investigation charge-sheet was filed against the accused. During the course of investigation, recovery of jewellery worn by the deceased, comprises of a finger ring and two ear rings were made on the instance and from the possession of the accused, charges were framed against the accused under Sections 449, 302, 394 and 201 I.P.C. The prosecution produced 14 witnesses and after recording statements of accused under Section 313 of Cr.P.C. Accused got himself examined in defence, 52 documentary exhibits were exhibited by the prosecution and the learned lower court, while culminating the trial passed the impugned judgment sentencing the accused for life coupled with distinct sentences under other sections as dwelt above. 3.

Heard the arguments of both the sides, learned counsel for the appellant-accused has contended that the trial court has committed error in passing the impugned judgment because there is no direct evidence and the matter is based on circumstantial evidence, the first information report given by the son of the deceased, was not having any disclosure relating to the allegations of robbery or murder but sheer accidental morgue was registered vide Exhibit-8, the alleged recoveries have also not been established and the appellant-accused has not made any extra-judicial confession, despite the same has been accepted as if it is substantiated, there was a hostility between the appellant-accused and the individuals making alleged disclosure of extra-judicial confession. The accused-appellant has also adduced his defence evidence, amicable and good relations were not there between the accused and victim family, so the appellant-accused has wrongly been involved on the basis of unfounded evidence. The cause of death of the deceased-lady could be a family discontent and despite contradictory and unfounded evidence, the learned trial court has held the appellant guilty, which is not sustainable under the eye of law, said witness Ramesh to whom extra-judicial confession has alleged to have been communicated was not produced by the prosecution but ignoring the lacunaes and contradictions of the evidence, the learned trial court has erroneously passed the judgment under appeal, which is liable to be quashed so, the appeal of the appellant-accused be accepted and the impugned judgment be set aside. Contrariwise, the learned Public Prosecutor has contended that there is no error in the findings of the learned trial court. The deceased, an old lady, was murdered by the accused, who was a neighbour and well aware about the loneliness and wearing of valuable jewellery and so prior to burning, she was given beating blows and ante-mortem injuries have been detected on her body. Jewellery of the deceased lady has been recovered from the possession and on the instance of the appellant-accused, even blood stained Razai and bed sheet have also been detected with the stains of blood, which have been examined by F.S.L. and the blood stains have been found there.

Evasive behaviour of the appellant-accused by not visiting to her home to condole the death of proximity living old lady, who was not even known but was having good relations with neighbours and accused-appellant was accustomed to visit her and there is no contradiction in the evidence of the prosecution. The prosecution has produced reliable evidence, which is corroborated by recovery as well as per medical evidence, so, the appeal of the appellant does not get any merit, it be dismissed and the trial court’s judgment be upheld. 4. Heard learned counsel for the appellant as well as learned Public Prosecutor and made appraisal of the evidence and perused the material available on record. 5. Recovery of finger ring and both ear rings of the deceased has been made on the instance of appellant- accused and information to this effect was given by accused vide Exhibit P.45, recovery of said ornaments have been made vide Exhibit P.14 and its spot map is Exhibit P.15 is well proved in the evidence. 6. PW-14 Dinesh Kumar, Investigating Officer, has said that during custody, the accused voluntarily informed that he has got buried the ear rings and finger ring of the deceased in Baba hut and this information was given by Exhibit P.45, which bears his signature and thumb impression of the accused. He has also said that on this information, he went there and got the said ornaments, recovered on information and on the instance of accused, who after digging the soil help recovered the ornaments which were identified by Vinod Kumar and its recovery memo is Exhibit P.14 and spot map of the recovery memo is Exhibit P.15. Both the witnesses of recovery PW-4 Radheshyam and PW-3 Vinod Kumar have corroborated and ratified the said recovery thoroughly.

Exhibit P.46 F.S.L. report discloses that human blood was found on Razai and bed-sheet i.e. on both cover of Razai and bed-sheet were also seized vide Exhibit P.4 and the prosecution witnesses have specifically narrated that blood stains were there on the Razai and bed sheet. Vide information as rendered by the accused per Exhibit P.44 recovery of “iron Saria” was also made by Exhibits P.11 and P.12 and both the recovery witnesses namely Radheshyam and Vinod Kumar have ratified the same in their evidence, respectively. 8. PW-11 Dr. H.R. Panwar conducting, post- mortem on the body of the deceased has made a significant narration that all the burns were post-death (post mortem) in nature and has further clarified that the burns were in the nature of “post death”. Exhibit P.36 post mortem report defines the position of thorax (iii) and at serial No.3 Larynx and Tracheae “carbon have not been found with the carbon articles” and it is mentioned that “carbon particals not present”. Exhibit P.41 has also got a recital that on the basis of post mortem report and disappearance of gold ornaments worn by the deceased, FIR under Sections 302, 201 and 394 I.P.C. was registered. 9.

All the witnesses, who went near the body of the deceased, PW-1 Shekhar Kumar, PW-2 Kripal Singh, PW-3 Vinod Kumar, PW-4 Radheshyam and PW-7 Ranveer photographer and the Investigating Officer have clearly said, that they did find a “bottle of Deshi liquor” there near the body of the deceased and PW-13 Chiman Lal, a “liquor vender”, has also said that on 13.3.2006 at about 9 P.M., he was sitting on his liquor shop where accused Sukhdev alias Sukha resident of Baktawali village, who was known to him, came there and took (bought) a bottle of “Deshi liquor” from him and has said that after purchasing the said bottle of liquor on 13.3.2006, he has not visited on a shop later, PW-1 Shekhar Kumar and PW-3 Vinod Kumar have also said that they were told by “Keshu and Bhajan” that they witnessed Sukhdev alias Sukha on 13.3.2006, who had brought a bottle of liquor from Theka and was found there under liquor consumption, it has also been observed by Shekhar Kumar and Vinod Kumar that they were apprised by Gurdeep and Ramesh that accused Sukhdev alias Sukha had made an extra-judicial confession before them by saying that he has committed a wrong by killing Smt. PW-2 Kripal Singh a teacher and neighbour of the deceased has said that he had been to the room of Vidhya Rani on 14.3.2006 where her burnt dead body was lying and has said that a half burnt currency note of Rs.20/- was lying there and an empty liquor bottle was also lying there near Charpai and half burnt “Bansatiya” timber were there. Razai and bed-sheet were having blood spots and he did not find ear rings and finger ring on the corpse of deceased and all these circumstances were suggesting that after killing her someone would have ignited her and she did not have committed suicide. 13. PW-4 Radheshyam has also narrated the circumstances as observed around the body and has said that rear side head-hair of deceased were half burnt and currency note of Rs.20/- in half burnt position was also lying and almost quasi-burnt timber of “bansatiya” were there and witnesses have ratified several exhibits prepared and as endorsed by them. PW-7 Ranveer is a photographer who has taken photographs from exhibits P.24 to P.30. He too has said that “an empty bottle of Deshi Liquor” was lying there near Charpai and a dead body of an old lady was there in the room. 14. Lalita is a police constable has said that she had obtained a packet containing empty bottle of liquor and chance prints developed from Malkhana incharge Ramswaroop and after getting a forwarding letter of S.P. office, proceeded to Jaipur and deposited the same there and its receipt is Exhibit P.33. PW-14 Dinesh Kumar is investigating officer, who has narrated entire sequence and proceedings conducted by him to investigate the matter and has corroborated the exhibit relating thereto.

He has also said that vide Exhibit 4 blood stained Razai cover and bed-sheet were seized and half burnt cloths, hairs and note of Rs.20/- were also sealed and seized vide Exhibit P.5 and has also told that empty bottle of Deshi liquor was recovered vide Exhibit P.5. He has also said that Sukhdev Singh alias Sukha was arrested vide Exhibit P.42 and voluntarily informed the place where he concealed Sariya vide Exhibit P.44, which was recovered vide exhibit P.11 on the instance of information of the accused, which contains the signature and thumb impression of accused, its spot map is Exhibit P.12. He has also said that vide Exhibit P.45, the accused had informed regarding concealment of jewellery of the deceased and this jewellery comprises of a gold ring and two ear rings of the deceased were recovered vide Exhibit P.1 and its spot map is exhibit P.15 which contains his signature and signatures of the accused and witnesses of the recovery. At the time of deposition and examination, almost all said “articles” have been ratified and confirmed by this investigating officer and he has also said that at the time of recovery Radheshyam and Vinod Kumar were there as recovery witnesses. 18. Sukhdev has also produced himself in defence and has denied the allegations but an important say which has been made by this witness is that as he has said that Smt. Vidhya Rani was residing opposite to his house and his son Shekhar was running a cloth store there in the said premises and has further said that it is true that Shekhar used to go away to his home in the evening, “which discloses that he was aware of the fact that Vidhya Rani was an aged lady who was residing in front of his house and was secluded every evening after departure of his son Shekhar and purchasing of Deshi wine bottle on 13.3.2006 from the shop of PW-13 Chiman Lal and detection of the same in empty position near the dead body of Vidhya Rani and recovery of looted ornaments of Vidhya Rani, which were regularly worn by her substantiates the crime. 19.

Careful scrutiny and appraisal of the aforesaid evidence discloses that the accused had purchased a Deshi liquor bottle from the shop of Gurmail Singh and he was found roaming near the house of the deceased consuming liquor and with a bottle of liquor. The gold finger ring and two ear rings of deceased which were removed from the body of the deceased were recovered from the possession and on the instance and information of the accused, which have been duly ratified by the recovery witnesses PW-3 and PW-4. Almost all the known witnesses of the deceased have said that, she used to wear gold ring and gold ear rings, which were absent and disappeared on her corpse and subsequently recovery of the same was made from the possession of the accused. A confessional say before Gurdeep Singh with revelation that accused under greed committed blunder by “killing” of Vidhya Rani and wanted to settle down the issue and asked them to help resolve tangle and a deposition to this effect by PW 8 Gurdeep singh makes everything explicit by connecting the appellant accused with the crime. The kind of evidence as discussed above is clinching and corroborative enough, which negates the innocence of the accused and positive enough to establish that the prosecution has succeeded to prove its case beyond any reasonable doubt against the appellant-accused. So, we are of the view that the trial court has not committed any wrong in passing the impugned judgment, hence, we find no merit in the appeal, which lacks merit, therefore, the same is dismissed and the impugned judgment is hereby confirmed.
