ORDER : Writ Petition (C) No.76 of 2015 1. This Court on 28th July, 2016, had passed the following order:- “In course of hearing, we have been apprised that once 848 post graduate seats were reverted to the States. In the present application, we are concerned only with five States, namely, Chhattisgarh, Jharkhand, Madhya Pradesh, Himachal Pradesh, Odisha and the University of Delhi. We have been apprised that in the State of Jharkhand, Chhattisgarh, Himachal Pradesh, Odisha and Delhi University, the seats vacated are 31, 15, 9, 80 and 99 respectively. As far as the State of Madhya Pradesh is concerned, Mr. Saurav Mishra, learned counsel appearing for the State of Madhya Pradesh, shall take instructions with regard to the seats which are still vacant. Regard being had to the aforesaid, we would require the Union of India to apprise us whether as a matter of policy, the seats that have remained vacant should be allowed to remain vacant or they should be allowed to be filled up. Learned counsel for the States shall prepare a memorandum about the nature of seats available in praesenti to the learned counsel for the petitioner. Let the matter be listed on 09.08.2016.” 2. Though, this Court had passed the aforesaid order, as advised at present, we are not inclined to extend the date as far as the States are concerned. We shall only deal with the interlocutory application filed against the University of Delhi and, accordingly, we proceed. 3. I.A. No.20 of 2016 in W.P.(C) No.76/2015 I.A. No.20 of 2016 for intervention has been filed by Mrs. Rajni Nijhavan, the applicant in-person. 4. Having heard the applicant in-person, Ms. Pinky Anand, learned Additional Solicitor General appearing for Union of India, Mr. Gaurav Sharma, learned counsel for the M.C.I. and Mr. Mohinder J.S. Rupal, learned counsel for the University of Delhi, we direct the University of Delhi to conduct one more counseling for 99 seats that are lying vacant, within two weeks hence. Wide publicity shall be given within a week from today so that all the students can be made aware of the same. If any student, who has already taken admission, he/she shall not be allowed to participate in the counseling. Needless to say, the counseling shall be done regard being had to the merit. 5.
