Today the matter comes upon an application filed by the learned counsel for the petitioner to decide the petitioner's writ petition in terms of the judgment dated 28.1.2016 rendered by this Court in the case of Devi Lal v. State of Rajasthan & Ors., who stands at par with the petitioner. 2. The petitioner is a retired Government servant having retired from the services of the respondent Land Revenue Department under the Collector, Sriganganagar. His pensionary benefits were withheld on the ground of pendency of a criminal case in the form of an F.I.R. No. 490/2011 registered at the Anti Corruption Bureau, Sriganganagar. The very same F.I.R. was registered against Devi Lal referred to supra, whose writ petition was allowed by this Court. 3. It is admitted by Dr. Pratishtha Dave, learned AGC that the State has taken a decision not to file an appeal against the order passed by Single Bench of this Court in Devi Lal's case (supra). 4. Consequently, the petitioner is entitled to the same relief as was extended to aforesaid Devi Lal. 5. The writ petition is thus allowed in the terms set out in Devi Lal's order (supra), the operative portion whereof is reproduced herein below: "9. Consequently, the above noted writ petition is allowed. The District Collector is to issue the, No Objection Certificate and thereafter the respondents are directed to release all retiral benefits to the petitioner and also to pay interest for the period during which the aforesaid payment was withheld in terms of Rule 89 of the Rules of 1996. The same is to be released within a period of three months from the date of receipt of certified copy of this order." The application is also disposed of. No order as to costs.
