ORDER : Nirmaljit Kaur, J. 1. This is Second Bail Application under Section 439 of Cr.P.C. The petitioners have been arrested in connection with FIR No. 379/2015, Police Station Nimbahera, District Chittorgarh for the offence under Section 8/15 of the N.D.P.S. Act. 2. The recovery in the present case is 70 kgs. of Poppy Husk from two persons. It is pointed out that the petitioners are in custody since 21.08.2015 and till now, no witness has been examined. 3. Taking into account the facts and circumstances of the case, this Court deems it just and proper to release the petitioners on bail. 4. Accordingly, this second bail application under Section 439 of Cr.P.C. is allowed and it is ordered that the accused-petitioners (1) Gurpal Singh s/o Nirmal Singh and (2) Gurvinder Singh s/o Sukhchain Singh shall be enlarged on bail provided each of them furnishes a personal bond in the sum of Rs. 50,000/- with two sureties of Rs. 25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so. Bail Application allowed.
