ORDER : This petition has been filed to transfer the complaint case of Petitioner in S.C. No. 191 of 2009 from the file of the Hon'ble Principal District Judge, Thoothukudi to the file of Hon'ble Principal District Judge, Tirunelveli for trial. 2. Heard the learned counsel for the petitioner. 3. On the complaint filed by the petitioner, a case in C.C. No. 3 of 2007 is pending on the file of Human Rights (Principal District and Sessions Court, Tuticorin) against the respondents herein. While so, the petitioner gave a representation dated 08.10.2015 to the Hon'ble Chief Justice of this Court, making silly allegations against the Presiding Officer. The Registry of this Court issued a communication dated 03.11.2015 to the petitioner, asking him to put those allegations in the form of an affidavit notarized by a Notary Public in accordance with extant rules. 4. The petitioner sent a reply to the Registry, contending that no Advocate is coming forward to notarize his affidavit. Thereafter, the petitioner has approached this Court for transfer of the case from the file of the Principal District and Sessions Court, Tuticorin to any other Court. 5. In Paragraph Nos.4 and 6 of the affidavit filed in support of this petition, he has made the following allegations: “4. I submit that my case is being pending since then and was got adjourned from time to time as the petition seeking to appoint a Spl. Public Prosecutor is pending before this Hon'ble Court, meantime some individual filed a suit before the same court wherein I am one of the defendant, when the matter came-up for hearing on 08.10.2015 I was to appear in-person since it was first hearing and there was court boycott by advocates, the Judge ill-treated the petitioner during the course of hearing which caused him mental agony and humiliation therefore the petitioner sent a complaint to the Hon'ble Chief Justice dated on 08.10.2015. 5. ...... 6.

I submit that despite that my petition seeking to appoint Spl Public Prosecutor is pending before this Hon'ble Court and taking note of the same the above said case of the petitioner gets adjourned from time to time but after the incident of sending complaint against him the Hon'ble Principal District Judge making his level best to dispose the case when the petition is pending before this Hon'ble Court regarding appointment of Spl P.P. and giving short adjournment, the all of sudden hurried hearing the case was came-up for hearing on 04.03.2016 and adjourned shortly on 07.03.2016 again it was adjourned to 21.03.2016, the Hon'ble Judge making observation that I am trying my level best to making complaint let him try and I am going my way, the said observation is highly disturbing me and the outcome of my case if he is heard my case.” 6. In the considered opinion of this Court, the aforesaid allegations do not even warrant calling for explanation from the Judicial Officer as that will demoralize the subordinate judiciary. 7. In the result, this petition is dismissed with cost of Rs.2,500/- payable by the petitioner to the M.S. Chellamuthu Trust & Research Foundation, No. 643, K.K. Nagar, Madurai -625020 (Phone No. 0452-2586448) within two weeks from the date of receipt of a copy of this order. Consequently, connected miscellaneous petition is closed.
