JUDGMENT Om Prakash-VII,J. Heard learned counsel for the applicant, learned A.G.A for the State and perused the material available on record. 2. This application under Section 482 Cr.P.C. has been filed by the applicant for quashing the order dated 10.06.2015 issuing non-bailable warrant passed by Additional District & Sessions Judge, Court No.5, Azamgarh in S.T. No.507 of 2007 (State Vs. Rajendra & others) under Section 147 , 323 149, 325, 308, 504, 506 I.P.C. Police Station- Meh Nagar, District Azamgarh arising out of case crime No. 168 of 2006. Further prayer has been made to stay the proceedings of the aforesaid case and effect and operation of the non-bailable order. 3. After arguing at length, learned counsel for the applicant submits that he does not want to press this application on merits and confines his prayer only to the extent that a direction may be issued to the court concerned so that the applicant may surrender before the court concerned. 4. In view of aforesaid, without expressing any opinion on the merits of the case, this application under Section 482 Cr.P.C. is disposed of with the direction that if the applicant surrenders before the court concerned within 15 days from today and applies for bail, his prayer for bail shall be considered and decided in view of the settled law laid down by the Full Bench of this Court in the case of Amrawati & Another Vs. State of U.P. reported in 2004 (57) ALR 290, as affirmed by Hon'ble Apex Court in the case of Lal Kamlendra Pratap Singh Vs. State of U.P. reported in 2009 (3) ADJ 322 (SC). 5. For a period of 15 days from today, effect and operation of the non-bailable warrant issued against the applicant shall be kept in abeyance. With the above directions, the application is finally disposed of.
