ORDER : The petitioner is seeking for a Mandamus directing the respondents to consider the petitioner's application dated 03.11.2015 seeking for electricity service connection to the premises located in S.No.173/2, Kodikulam Circle, Kottaipattinam Village, Manamelkudi Taluk, Pudukottai District. 2. The grievance of the petitioner is that such application filed by the petitioner was returned by the respondent Electricity Board by contending that the petitioner should produce tax receipts issued by the Panchayat in proof of possession of the said property. The further grievance of the petitioner is that such tax receipt is not issued by the Panchayat at the instigation of some rival claims. 3. Per contra, learned Counsel appearing for the respondents submitted that the application filed by the petitioner was already returned and therefore, it is for the applicant to represent the same with necessary fees along with necessary documents. 4. Considering the facts and circumstances of the present case and also considering the relevant Clause 27(4) of the Tamil Nadu Electricity Distribution Code-2004 which takes care of the cases like the one on hand, it is open to the petitioner to represent the application along with necessary fees and documents in proof of possession of the premises before the third respondent, within a period of two weeks from the date of receipt of a copy of this order. On receipt of such application along with the said documents and necessary fees, the third respondent shall consider such application and pass appropriate orders in the light of the provisions made under Clause 27(4) of the Tamil Nadu Electricity Distribution Code-2004, within a period of two weeks from the date of receipt of application. It is also made clear that the respondent can also seek for execution of indemnity bond in Form No.VI, if it is so warranted. 5. With the above direction, this Writ Petition is disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
