JUDGMENT The petitioner seeks the following reliefs invoking the jurisdiction in the public interest litigation: "(a) Issue a writ, order or direction in the nature of certiorari quashing the process of above recruitment and appointment of 47 Professors in various specialities of Allopathy of the State Government under the Director General of Medical Education and training, Uttar Pradesh, as per advertisement no 02/15-16 dated 21.12.2015 (Annexure No.1). (b) Issue a writ, order or direction in the nature of mandamus directing the respondents to ensure that proper opportunity of selection and appointment on atleast 50% post of Professor is made in accordance with reservation policy of the State Government of Uttar Pradesh for SC/ST and OBC candidates in public interest." 2. The disclosure which has been made in paragraphs 8 and 9 of the petition is in the following terms: "8. That the petitioner has passed M.B.B.S. and M.D. in psychiatry from S.N. Medical College, Agra and at present is appointed as Assistant Professor of Psychiatry in Rama Medical College, Kalyanpur, Kanpur which is recognised by Medical Council of India as well as by State Government. 9. That petitioner is Pasi (Paswan) by caste which belongs to scheduled caste category and entitled to the benefit of reservation of 21 % seats i.e. for 9 posts of Professor out of 47 posts." 3. This disclosure is sufficient in itself to indicate that a public interest litigation cannot be entertained. However, we leave it open to the petitioner or to an aggrieved individual to seek recourse to the remedies available in law for pursuing a personal grievance. The petition is accordingly dismissed. There shall be no order as to costs.
