JUDGMENT Manoj Kumar Gupta,J. Supplementary affidavit filed today is taken on record. 2. The petitioner claims himself to be a life member of the General Body of a registered Society in the name of Robertsganj Sanskrit Vidyalaya Samiti, Robertsganj. He has approached this Court contending that the last election of the office bearers was held on 19 January 2011, in which respondent No. 3 was elected as Manager and although, the terms of the said Committee under the approved bye-laws is three years, but it is still continuing illegally and is also seeking to make appointments in the Institution being run by it. Accordingly, the petitioner has prayed for a writ of mandamus directing the respondent No. 2 (District Inspector of Schools, Sonebhadra) to appoint an Authorised Controller and to restrain respondent Nos. 3 & 4 from making any appointment in the Institution. 3. The copy of the election proceedings dated 9 January 2011 has not been brought on record. There is no material on record to indicate that respondent Nos. 3 & 4 are managing the Society or the Institution being run by the Society on the basis of election dated 19 January 2011. On the other hand, there is on record an order dated 26 June 2013 passed by the Vice Chancellor of Sampurannand Sanskrit University in exercise of power under section 2(13) of the U.P. State Universities Act, 1973 whereby, on basis of a resolution dated 14 April 2013, the Committee of Management of the Institution has been accorded recognition for a period of three years. Thus, if the tenure of the Committee is construed from the date of recognition, its term has not yet expired. In such view of the matter, this Court is not inclined to issue any mandamus, as prayed for in the writ petition, but leaves it open to the petitioner to press the representation, which is stated to be pending before the second respondent. 4. With the aforesaid clarification, the writ petition stands dismissed.
