JUDGMENT Ganesh Shankar Mishra, petitioner, is before this Court, assailing the validity of the order dated 31.03.2016 passed by learned Single Judge in Writ Petition No.3487 of 2016 (Ganesh Shankar Mishra vs. State of U.P. and others), wherein learned Single Judge has proceeded to dispose of the writ petition in question with the direction upon the respondent no.2 to examine the claim of petitioner, as raised in his representations dated 02.12.2015 and 07.01.2016 with reference to the policy contained in the order dated 24.09.2015 by means of a reasoned/speaking order, within a period of four weeks from the date of presentation of certified copy of the order. 2. Shri Rajesh Rai, Advocate has tried to contend before this court that though learned Single Judge has proceeded to give directions to the respondent no.2 to examine the claim of petitioner-appellant in consonance and in reference of policy contained under order dated 24.09.2015, same would add to litigation and as such, this Court should intervene in the matter. 3. Shri G.D. Mishra, Advocate, on the other hand, contended that whatever claim has been sought to be raised, qua the same rightful orders have been passed as at the first instance, the claim of the petitioner-appellant could be examined by the Managing Director, Pradeshik Co-operative Dairy Federation Ltd., Lucknow and as such, no interference be made in the order impugned. 4. We have proceeded to examine the order dated 31st March, 2016 and what we find that in pith and substance, the grievance of petitioner-appellant has been that Circular dated 24th September, 2015 is being breached and the exercise that is being taken on the spot, is not at all in consonance with the spirit of the circular dated 24th September, 2015. 5.

Once the entire grievance of the petitioner-appellant has been that whatever exercise has been undertaken, same is in breach of circular dated 24th September, 2015 and thereafter the learned Single Judge has given liberty to the petitioner-appellant to get his claim disposed of by the Authorities concerned in consonance with the policy contained in Circular dated 24th September, 2015, then in our considered opinion, the interest of petitioner-appellant is fully protected as the Managing Director, Pradeshik Co-operative Dairy Federation Ltd., Lucknow has got full competence to consider as to whether the claim of petitioner-appellant has got substance or not and in case, orders are passed that claim of petitioner-appellant has got no substance, then even this Court would be in a position to examine the reasons given by the Authority concerned has got any substance or the same is unfounded one, in view of this, as rightful orders have been passed, no interference is required to be made by us. 6. Special Appeal is dismissed accordingly.
