ORDER : The prayer in the Writ Petition is for a Writ of Mandamus to directing the second respondent to lease out the fishery right to the petitioner for the Fasli year 1425 of Podipithan Kanmai situated in Singammalpuram Village, Srivilliputhur Taluk, Virudhunagar District, considering the petitioner's deposit amount of Rs.10,000/-(Rupees Ten Thousand only) for the Fasli 1454. 2. Mr.N.S.Karthikeyan learned Additional Government Pleader takes notice for the first respondent and Mr.M.Raja Rajan, takes notice for the second respondent. 3. By consent, the writ petition itself is taken up for final disposal. 4. The learned Counsel appearing for the petitioner submits that the petitioner has already deposited a sum of Rs.10,000/-by way of Banker's Cheque dated 10.03.2015 which is lying with the respondent towards fishery right for the Fasli 1454. The petitioner further undertakes to pay the amount as stipulated in the G.O.No.169 dated 16.08.1999. 5. It is for the respondent to decide whether the petitioner has got any fishery right or not for the Fasli year 1425 of Podipithan Kanmai situated in Singammalpuram Village, Srivilliputhur Taluk, Virudhunagar District, on merits. Without going into the merits of the case, the second respondent is directed to decide the fishery right for the Fasli year 1425 of Podipithan Kanmai situated in Singammalpuram Village, Srivilliputhur Taluk, Virudhunagar District, on merits and in accordance with law. It is needless to say, that if fishery right is not granted to the petitioner the second respondent shall return the amount already deposited by the petitioner immediately. 6. With the above direction, this Writ Petition stands disposed of. No costs. Consequently, the connected Miscellaneous petition is closed.
