JUDGMENT Heard Mr. Ramesh Prasad Awasthi, learned counsel for the petitioner as well as Mr. Rajiv Singh Chauhan, learned counsel for the Mandi Parishad. 2. The petitioner has prayed for issuing a mandamus to the respondents to remove Sabzi Mandi (Vegetable Market), Tamachpur, district-Behraich. The petitioner has claimed to be a wholesale vegetable merchant, therefore, he has raised objection against the retail market, which is being organized by the retailers in the respective area. He had represented to the several local authorities to remove the retail Sabzi Mandi. In furtherance of which the City Magistrate/Chairman, Mandi Samiti, Behraich had demanded some police force by the Additional Superintendent of Police, Behraich to remove the said market. 3. Thus, it appears that the process for removal of illegal market is under operation, therefore, we hereby give liberty to the petitioner to pursue his claim to the Chairman, Mandi Samiti, Behraich for removal of illegal encroachment. It is further provided that on demand of the authority of Mandi Samiti, District Police Officer shall provide proper assistance to the officer concerned for removal of encroachment. 4. With the aforesaid observations, the writ petition stands disposed of finally.
