JUDGMENT : Tejinder Singh Dhindsa, J. Petitioner seeks benefit of regular bail pending trial in case FIR No. 122 dated 08.04.2015, under Sections 409, 420, 467, 468, 471 of Indian Penal Code, registered at Police Station Safidon, District Jind. 2. Counsel for the parties have been heard. 3. Allegations in a nutshell are that the petitioner having abused his authority and position while holding the post of Sarpanch has allegedly misappropriated a sum of Rs. 4 lacs approximately and which funds were meant for distribution amongst the old age pensioners of the village. 4. On the last date of hearing, this Court had taken note of the fact that the relevant document reflecting the signatures of the petitioner for withdrawal of the money from the Bank has been sent to the Forensic Science Laboratory and the report was still awaited. 5. Accordingly, hearing in the present petition was deferred from 06.04.2016 to today. 6. Court has been apprised that the report is still awaited. 7. Petitioner has been in custody since 15.01.2016. 8. In view of the above and without making any observations on merits as also by taking into account the length of incarceration suffered, petitioner is held entitled to the benefit of bail. 9. Petition is allowed. Petitioner be enlarged on bail subject to satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Jind. 10. Disposed of.
