JUDGMENT The petitioner being posted as medical officer under the Chief Medical Officer, Ghazipur had taken medical leave for a period from 22.6.2011 to 3.10.2012, which has been in the permissible limit, therefore, the petitioner has claimed his entitlement to get it sanctioned by the competent authority. He has also represented to the State Government through several representations. The last one is of 4 February 2016, but all in vain. Therefore, he has come forward to invoke the jurisdiction of this Court under Article 226 of the Constitution of India to issue a mandamus to the Principal Secretary, Medical and Health Services to sanction his medical leave. 2. In view of the submissions made above, at this stage, since the matter is pending consideration with the State Government, we feel it appropriate to issue direction to the respondent No.1 to take a decision in the petitioner's matter to sanction his medical leave within two months from the date of communication of this order. On the event of decision taken by the authority concerned the petitioner shall be paid emoluments of medical leave immediately thereafter. In the aforesaid terms the writ petition is disposed of finally.
