JUDGMENT Heard Ms. Meena, learned A.G.A. on behalf of State and perused the record. 2. The instant Government Appeal has been preferred against the judgement and order of acquittal dated 13.1.2016 passed by Additional Session Judge/F.T.C. District Hathras in S.T. No. 323 of 2015 (State of U.P. Vs. Manoj alias Bhoora and others), arising out of Case Crime No. 336 of 2015, under Sections 498-A, 304-B, 201, 302 I.P.C. & 3/4 D.P. Act, P.S. Sikandrarau, District Hathras. 3. Learned AGA submitted that there was a specific allegation regarding demand of dowry and torture within one year of marriage, she was assaulted and killed by the accused-respondents and dead body was cremated. Apart from that, it was burden of the accused-respondents to show how she died. Hence, the impugned judgement and order being against the evidence on record is liable to be set aside. 4. Considered the submissions. According to prosecution case, the first information report was lodged by informant Ganga Prasad, father of the deceased Smt. Kirti, who was married to accused-respondent Manoj @ Bhoora about 11 months before the date of incident. As per allegation, there was demand of motorcycle. On 10th May, 2015, informant got an information through villagers that his daughter was killed and body was concealed somewhere else. The statement of the witnesses were recorded, it was found that the demand of dowry and torture could not be proved. There was contradictory statement of P.W. 1 informant. According to P.W. 3 Anita sister of the deceased, there was no demand of dowry, she fell down from the stair. She never made complaint regarding demand of dowry and torture. According to P.W. 6, maternal uncle there was no demand of dowry and torture. 5. In view of the fact the view taken by the trial court is reasonable and is one of the view possible in the present case and as such it is not a fit case for interference in the impugned order of acquittal.
