JUDGMENT M/S Hindustan Auto Mobile is before this Court with a grievance that they have extended the facilities as has been asked for by the State Authorities for conducting Vidhan Sabha Elections in question and their bills in question are not at all being settled and petitioner is being made to run from pillar to post. 2. Reliance in this regard has been placed on an earlier judgement of this Court in Writ Petition No.56399 of 2013 (M/S Hindustan Auto Mobile vs. State of U.P. and others), wherein this Court has given following directions: "This Court also further proceeds to mention that the Chief Election Commissioner U.P. at Lucknow should see all the matters wherein services have been taken by the respective District Election Officer and thereafter where the matters have been sent to the Chief Election Commissioner U.P. at Lucknow, the said matters should be finalized at the earliest and at the point of time when such decision is taken, the judgment in the case of Raj Kumar Agarwal and others Vs. State of U.P. and others passed in Civil Misc. Writ Petition No.2676 of 2009 should be taken into consideration wherein this Court has proceeded to mention that once the respondent authorities have taken services in question then the corresponding duty is cast upon them to pay the amount in question within a reasonable time." 3. At the point of time when the matter has been taken up, we have heard learned Standing Counsel, Shri B.N. Singh, Advocate representing State Election Commission and Shri Shambhu Chopra, Advocate, who has rendered his valuable assistance on behalf of Election Commission of India and in our considered opinion, once services have been rendered by the petitioners as is being claimed by them and their bills in question are not at all being settled, then in all eventuality, the Chief Election Commissioner should look into the grievance of petitioner. 4. Consequently, in the facts of the case, we proceed to ask Chief Election Commissioner to look into the grievance of petitioner and redress the same in accordance with law, preferably within two months from the date of passing of this order. 5. With these observations, writ petition is disposed of.
