JUDGMENT Manoj Kumar Gupta,J. A supplementary affidavit has been filed today stating that the institution being run by the petitioner Committee is imparting education from class I to V and by inadvertence in paragraph 13 of the writ petition, it has been mentioned that the institution is imparting education upto standard VIII. The claim raised by the petitioner in the instant writ petition is for considering the request of the institution being run by it to be provided with financial aid by the Government as per the provisions of Right of Children to Free and Compulsory Education Act, 2009. 2. Learned standing counsel appearing on behalf of the State respondents and Sri R.P. Singh for respondents 4 & 5 have pointed out that the controversy in this regard, is now covered by the direction issued by this Court in its order dated 5 November, 2015 in Writ-C No. 62182 of 2015 (Gram Vikas Sewa Samiti & another Vs. Union of India & others). In the said writ petition, this Court after considering a Division Bench Judgement of this Court in the case of Paripurna Nand Tripathi and another vs. State of U.P. and others ( 2015 (3) ADJ 567 ), directed the State Government to frame a policy in regard to disbursement of grant-in-aid to institutions imparting elementary education to the children and governed by the provisions of Right of Children to Free and Compulsory Education Act, 2009 within a period of three months. It was further provided therein that after the policy is framed, the case of the petitioner in that writ petition shall be dealt with accordingly. 3. Learned counsel for the respondents do not dispute that the petitioner herein, is also entitled to the benefit of direction given in the said judgement and in case, policy is framed by the State Government, the petitioner institution which is imparting elementary education would also be entitled to be considered in accordance with the policy. 4. Accordingly, this writ petition also stands disposed of in same terms and conditions, as were issued by judgment dated 5.11.2015 in the case of Gram Vikas Sewa Samiti & another Vs. Union of India & others.
