JUDGMENT Ashwani Kumar Mishra,J. Petitioner is aggrieved by orders dated 16th March, 2016 and 17th March, 2016, communicating him that he shall retire on 31st August, 2016. According to petitioner, his correct date of birth is 15.5.1958, as per School Leaving Certificate, whereas it has wrongly been mentioned as 29th August, 1956. The order under challenge records that petitioner's date of birth is correctly mentioned in his service book, and the same requires no correction. 2. According to the averments made in the writ petition, it is only in 2016 that petitioner came to know that he is going to retire in the year 2016. However, there is no averment that petitioner has not signed the service book, or that the entry made therein was not in his knowledge. Even otherwise, under the provisions of U.P. Recruitment to Services (Determination of Date of Birth) Rules, 1974, as has been amended in 1980, clearly provides that the entry of date of birth in the service book would be treated to be final. Law is otherwise settled that such claims are not to be entertained at the fag end of one's career. Petitioner claims to be working since 1973, and in case, his contention is accepted, he would be a minor on the date of his entry into service. The claim of petitioner, as raised in the writ petition, is contrary to the provisions of Rules, operating in the field, and as such, the same need not be entertained. The writ petition lacks merit, and is accordingly dismissed.
