JUDGMENT : Rajesh Bindal, J. Learned counsel for the petitioner submitted that he may be permitted to withdraw the present petition to enable him to avail of alternative remedy against the impugned order of termination dated 29.5.2012 before the Educational Tribunal. However, he submitted that since the petitioner had filed the present petition in this court on 7.6.2012, the delay, if any, in availing the remedy before the Educational Tribunal, may be condoned. Dismissed as withdrawn with liberty as prayed for. As regards delay, suffice to state that in case the period for availing of the remedy before the Educational Tribunal expired during the pendency of the writ petition before this court, the Educational Tribunal shall consider this aspect and hear the case on merits after condoning the delay, if any.
