ORDER : 1. The petitioner, through his natural guardian, father, has preferred this revision petition aggrieved by the order dated 01.07.2016 passed by the Juvenile Justice Board, Jodhpur and order dated 28.07.2016 passed by the Sessions Judge Jodhpur Metropolitan. 2. It is contended by counsel for the petitioner that the petitioner is a juvenile in conflict with law who has been apprehended with fake currency. It is contended that the gravity of the offence is not to be considered while dealing with an application for grant of bail of a juvenile in conflict with law. 3. Learned Public Prosecutor has opposed the revision petition. His contention is that the petitioner was found in possession of 29 fake Rs. 500 currency notes. 4. I have considered the rival contentions. 5. As per the report received, the petitioner's parents are old and infirm and poor residing in Kacha house. There is nothing on record to suggest that his release would bring him into custody of known or unknown criminals. Further there is nothing on record to suggest that his release would defeat the ends of justice. 6. Considering the fact that the gravity of the offence is not to be looked into while dealing with an application for release of juvenile in conflict with law, I am inclined to allow the revision petition. 7. It is directed that the petitioner Jatta son of Hakalu Choudhary, be released on bail, provided his natural guardian, father, furnishes a personal bond in the sum of Rs.25,000/- alongwith two sureties in the like amount each to the satisfaction of the concerned Juvenile Justice Board with the stipulation that she shall produce the petitioner before the concerned Juvenile Justice Board on all dates, till the enquiry or trial is completed. His natural guardian, mother shall ensure that the juvenile in conflict with law maintains good conduct and behaviour.
