JUDGMENT : Heard. 2. Counsel for the petitioner prays that he may be allowed to withdraw the writ petition giving liberty to the petitioner to file an appeal against the impugned order before the Rajasthan Non-Government Educational Institutions Tribunal with the observation that bar of limitation shall not apply against the petitioner while entertaining the appeal. 3. Having regard to the facts and circumstances of the case, the instant writ petition is dismissed as with drawn with liberty to the petitioner to challenge the impugned order of cancellation of recognition by taking recourse of statutory remedy of appeal provided under Rule 8 of the Rajasthan Non- Government Educational Institutions Rules, 1993. In case, the petitioner submits the appeal within a period of 30 days from today along with copy of this order, the same shall be treated to be within limitation. Upon such appeal being filed, the Tribunal shall consider and decide the same as per law expeditiously. For a period of one month from the date of submission of appeal, the respondents shall not take any coercive steps against the petitioner. 4. Stay petition also stands dismissed.
