JUDGMENT Mr. Inderjit Singh, J.:- Prayer in the present application is for suspension of sentence of applicant-appellant Charan Singh, during the pendency of appeal. 2. Notice of the application to respondent(s)-State. 3. On the asking of the Court, Ms. Shivali, AAG, Punjab, has accepted notice on behalf of respondent(s)-State and filed custody certificate. Same is taken on record. 4. Learned Judge, Special Court, Patiala, vide judgment of conviction dated 17.02.2016 and order of sentence dated 20.02.2016, held the applicant-appellant guilty for the commission of offence punishable under Section 18 of the Narcotic Drugs & Psychotropic Substances Act, and sentenced him to undergo rigorous imprisonment for a period of 03 years and to pay a fine of Rs.1,00,000/- under the aforesaid Section. 5. Feeling aggrieved against the said judgment of conviction and order of sentence, the applicant-appellant filed an appeal which has been admitted by this Court vide order dated 14.03.2016. 6. As per custody certificate, produced by learned State counsel, applicant-appellant has already undergone 05 months and 20 days of actual sentence. The recovery effected from the applicant-appellant is 01 kg. opium which falls in non-commercial quantity. 7. The appeal is not likely to mature for hearing in the near future. Keeping in view the facts and circumstances of the case and the fact that the recovery effected from the applicant-appellant is 01 kg. opium which falls in non-commercial quantity, the criminal miscellaneous application is allowed and the sentence of imprisonment of applicant-appellant during the pendency of appeal shall remain suspended and he is admitted to bail subject to his furnishing personal and surety bonds to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Patiala, and further subject to the condition that he shall not leave the country without the prior permission of this Court.
