ORDER : N.V ANJARIA, J. Heard learned Advocate Mr. A.S Asthavadi for the petitioner and learned Assistant Government Pleader Mr. Bhargav Pandya for the respondents. 2. By filing the present petition, the petitioner Association has prayed for paying interest on the delayed payment of provident fund amount. For the prayer made, reliance is placed on decision of this Court in Kheda Anand District Retired Primary Teachers' Association v. State of Gujaratbeing Special Civil Application No. 2322 of 2009 and cognate petitions decided on 04th May, 2009 which in turn is confirmed by the Division Bench in Letters Patent Appeal No. 1308 of 2010 and others decided on 23rd June, 2010. The petitioner is an Association of retired Primary Teachers of Vijaynagar Taluka, District Sabarkantha and it is stated to have register status. It works for protection of and espousing of rights of its members. It is their case that many members of the petitioner, after retirement, received provident fund amount after more than three months and that for the delayed period, they are entitled to interest. 3. In Kheda Anand District Retired Primary Teachers' Association(supra), this Court held, “… … … It is held that that the respective petitioners are entitled to receive the interest on GPF at the rate of 8% per annum for the first three months from the date of the retirement i.e entitlement to receive the GPF and thereafter after three months they are entitled to receive the penal interest at the rate of 12% per annum on the delayed payment of GPF till it is actually paid. Concerned respondents are directed to make the payment of interest accordingly to the respective petitioners within a period of three months from today. … …” (Para 7) 4. The Division Bench in Letters Patent Appeal No. 1308 of 2010 recorded its confirming findings as under. “Learned Single Judge has, in the impugned common judgment, took the view that an employee is entitled to receive regular interest on the amount lying to her credit in the GPF account even for the first three months of her retirement and denial of such interest for the first three months after retirement was absolutely illegal and arbitrary.
“Learned Single Judge has, in the impugned common judgment, took the view that an employee is entitled to receive regular interest on the amount lying to her credit in the GPF account even for the first three months of her retirement and denial of such interest for the first three months after retirement was absolutely illegal and arbitrary. It could not be gainsaid that whatever amount is deposited in the GPF account of an employee, he/she is entitled to interest thereon as long as he/she is in service and there is no reasonable ground to deny such interest at the same rate as long as the amount credited to the account of an employee, to whom the amount really belongs, is actually paid. Therefore, no ground is made out and we do not find any reason to interfere with the logical and reasonable direction to pay interest @8% p.a on the amount lying deposited in the GPF account of an employee, even after retirement till the amount is actually paid. The rate of interest @12% is already imposed by the resolutions of the government itself, but since it appears to be by way of penal interest for inordinate delay of more than three months in making payment of the GPF amount, it could not have been applied immediately upon retirement of an employee. Thus, in short, we do not find any infirmity in the impugned common judgment………. …” 5. In view of the above and having regard to decision of this court in the aforesaid Special Civil Application No. 2322 of 2009 confirmed in Letters Patent Appeal No. 1308 of 2010, the petition deserves to be allowed by granting relief to the petitioners. Accordingly, it is directed that each of the petitioner-employee mentioned in para-4 hereinabove shall be entitled to and shall be paid interest on the delayed payment of Provident Fund amount. Such interest shall be paid at 8% p.a and if the delay in payment is beyond 3 months, the interest shall be at the rate of 12% from the end of the third month till the amount was actually paid. The above benefit of payment of interest shall be availed by paying the amount to each of the employee mentioned within three months from the date of receipt of this order. 7. Direct service is permitted.
