JUDGMENT : Daya Chaudhary, J. The prayer in the present petition is for issuance of a writ in the nature of mandamus directing the respondents to fix the seniority and pay of the petitioner in the same terms as has been granted to the persons junior to her in view of statutory rules and the law laid down by this Court in various judgments. 2. Learned counsel for the petitioner submits that the petitioner is much senior to the persons to whom the benefit has been granted. The petitioner made a representation to the authorities concerned but no action has been taken thereupon so far. Ultimately, a legal notice was also served upon the respondents on 12.02.2016, which is annexed as Annexure P-10 with the petition. Learned counsel further submits that the petitioner would be satisfied, in case, the directions are issued by this Court to decide the legal notice, which is still pending. 3. Keeping in view the limited prayer of the petitioner and also the fact that no order has been passed on the legal notice as well as in the representation, the present petition is disposed of with a direction to respondents No.1 and 2 to take action on the legal notice dated 12.02.2016 (Annexure P-10) by passing a speaking order in accordance with law within a period of two months from the date of receipt of certified copy of this order. 4. However, in case, the petitioner is found to be entitled for the relief sought for in the legal notice, the same be granted to her within a period of three months thereafter. 5. The petition is disposed of accordingly.
